These Subscribe & Save Terms and Conditions these “Subscription Terms” govern your enrollment in and use of any recurring subscription, auto-renewal, subscribe-and-save, auto-ship, or similar program offered by Towed Home, LLC d/b/a Tows Coffee Co. (collectively “Tows Coffee Co.,” “Tows,” “Company,” “we,” “us,” or “our”). By enrolling in Subscribe & Save or placing a subscription order, you agree to these Subscription Terms, our Website Terms and Conditions, Privacy Policy, and Terms of Sale. If you do not agree, do not enroll in Subscribe & Save.

I. PROGRAM OVERVIEW. Subscribe & Save allows you to receive eligible Tows Coffee Co. products on a recurring basis at the frequency you select, subject to product availability, payment authorization, shipping restrictions, and these Subscription Terms. Eligible products may include coffee grounds, single-serve coffee pods/K-Cups, ready to drink beverages and other products we designate as eligible.

II. AUTOMATIC RENEWAL AND RECURRING CHARGES. SUBSCRIBE & SAVE IS AN AUTOMATIC RENEWAL PROGRAM. BY ENROLLING, YOU AUTHORIZE TOWS COFFEE CO. AND OUR PAYMENT PROCESSORS TO AUTOMATICALLY CHARGE YOUR PAYMENT METHOD ON A RECURRING BASIS FOR EACH SUBSCRIPTION ORDER UNTIL YOU CANCEL. Your subscription will continue and automatically renew at the selected delivery frequency unless and until you cancel, we cancel, or the subscription is otherwise terminated in accordance with these Subscription Terms.

III. INITIAL ORDER. When you enroll in Subscribe & Save, your first order may be processed immediately unless otherwise stated at checkout. Your selected payment method will be charged for the initial order at the time shown at checkout.

IV. RENEWAL ORDERS; PRE-SHIPMENT NOTICE. After your initial order, we will automatically create renewal orders according to your selected delivery frequency. Before each renewal order, we will send a reminder notice to the email address or contact method associated with your account where required by law or as otherwise determined by us. The notice may include the product, quantity, estimated price, estimated taxes, estimated shipping charges, scheduled processing date, and instructions for changing or cancelling the subscription. You are responsible for reviewing each notice and making changes before the applicable cutoff time.

V. HOW TO MANAGE, SKIP, PAUSE, OR CANCEL. You may manage your subscription by logging into your account and using the subscription-management link provided in subscription emails, or contacting us at . Subject to the applicable cutoff time, you may be able to:

a.      change product selections;

b.      change quantities;

c.       change delivery frequency;

d.      update shipping address;

e.      update payment method;

f.        skip a shipment;

g.      pause a subscription; or

h.      cancel a subscription.

You may cancel at any time, but cancellation must be completed before the applicable cutoff time for the next order. If an order has already been processed, packed, shipped, or charged, cancellation may apply only to future orders.

VI. ORDER LOCK. Unless a different cutoff is stated in your account, checkout, or pre-shipment notice, changes or cancellations must be made by the 15th day of the preceding month before the scheduled shipment date. For example, if you want to cancel, pause, or change a subscription order for the month of January, then you must notify us by December 15th. We may, but are not required to, accommodate late changes.

VII. PRICING. The price charged for each subscription order will be the price for the applicable product at the time the order is processed, less any applicable Subscribe & Save discount, plus applicable taxes, shipping, handling, and other charges. Prices may change over time. Subscription discounts, product eligibility, shipping charges, and promotional benefits may also change. Where required by law, we will provide notice of material changes before they apply.

VIII. SUBSCRIBE AND SAVE DISCOUNTS. Eligible Subscribe & Save products will receive a ten percent (10%) discount shown at checkout or in the applicable offer. Discount amounts, eligibility, and program benefits may vary by product, customer, promotion, or time period and may be modified, suspended, or discontinued at any time. Unless expressly stated otherwise, Subscribe & Save discounts may not be combined with other promotions, discounts, bundles, referral credits, or loyalty rewards. The discount will apply before taxes, shipping charges, and any other charges that may be applicable.

IX. TAXES AND SHIPPING. Each subscription order may be subject to applicable taxes, shipping charges, handling charges, and other fees. We aim to ship your monthly subscription on the first Monday of each month.

X. PAYMENT AUTHORIZATION. By enrolling in Subscribe & Save, you authorize us and our payment processors to charge your payment method for each subscription order without further authorization from you until you cancel or update your payment method. You agree to keep your payment information current. If your payment method cannot be charged, we may:

a.      notify you and request updated payment information;

b.      retry the payment method;

c.       charge another valid payment method associated with your account where permitted;

d.      delay shipment;

e.      skip the order;

f.        suspend the subscription; or

g.      cancel the subscription.

XI. PRODUCT AVAILABILITY AND SUBSTITUTIONS. Subscriptions are subject to product availability. If a subscription product is out of stock, discontinued, delayed, recalled, unavailable, or otherwise cannot be fulfilled, we may delay the order, skip the shipment, cancel the affected product, cancel the subscription, or contact you regarding available options. We will not send a materially different substitute product without your consent where required by law.

XII. CHANGES TO PRODUCTS OR PROGRAM. We may modify, suspend, or discontinue Subscribe & Save, any subscription benefit, any eligible product, any discount, or any program feature at any time. Changes will apply to future orders unless otherwise stated. Your continued participation after changes become effective constitutes acceptance of those changes. If you do not agree to changes, you must cancel your subscription.

XIII. RETURNS AND REFUNDS. Subscription products are subject to our Terms of Sale and return/refund policy. Because coffee and ready-to-drink beverages are consumable products, returns may be limited. Cancellation of a subscription does not automatically cancel, return, or refund an order that has already processed or shipped.

XIV. ACCOUNT AND CONTACT INFORMATION. You are responsible for keeping your account, shipping address, billing address, payment method, and contact information accurate and up to date. We are not responsible for missed notices, failed deliveries, incorrect shipments, or additional costs caused by outdated or inaccurate information.

XV. PERSONAL USE ONLY. Subscribe & Save is intended for personal or household use only. You may not use Subscribe & Save for resale, marketplace distribution, unauthorized commercial purchasing, or export. We may limit, suspend, or cancel subscriptions that appear to violate this policy.

XVI. TERMINATION BY US. We may suspend, modify, or cancel any subscription at any time, including for payment failure, suspected fraud, misuse, inventory issues, shipping restrictions, violation of these Subscription Terms, excessive returns, or other business reasons. If we cancel a subscription, you will only be charged for orders already processed or shipped, subject to applicable law.

XVII. NOTICES. Subscription notices may be sent by email, SMS/text, account message, or other contact method associated with your account. You consent to receive electronic communications related to your subscription.

XVIII. VOID WHERE PROHIBITED. Subscribe & Save is void where prohibited or restricted by law. We may restrict the program by product, location, customer, quantity, or shipping destination.
